Nursing Roles in Litigation
- Expert liability witness, testifying:
- Review medical records.
- Possibly research standard of care at the time of the incident.
- Testify in deposition and at trial if needed.
- Expert liability witness, consulting (role varies):
- Organize and synthesize medical records.
- Research medical issues, and prepare memos and bibliographies on case issues.
- Research nursing and medical standards of care.
- Summarize depositions of medical or nursing witnesses.
- Suggest other medical or nursing experts in fields relevant to the issues in the litigation.
- Expert damage witness:
- Review medical records.
- Consult with treating health care providers.
- Develop a plan of care for the injured person, projecting needs for health care, equipment, and personnel (attendant, nursing, etc.), including associated costs.
- Attend Independent Medical Examinations
