Nursing Roles in Litigation

  1. Expert liability witness, testifying:
    • Review medical records.
    • Possibly research standard of care at the time of the incident.
    • Testify in deposition and at trial if needed.
  2. Expert liability witness, consulting (role varies):
    • Organize and synthesize medical records.
    • Research medical issues, and prepare memos and bibliographies on case issues.
    • Research nursing and medical standards of care.
    • Summarize depositions of medical or nursing witnesses.
    • Suggest other medical or nursing experts in fields relevant to the issues in the litigation.
  3. Expert damage witness:
    • Review medical records.
    • Consult with treating health care providers.
    • Develop a plan of care for the injured person, projecting needs for health care, equipment, and personnel (attendant, nursing, etc.), including associated costs.
  4. Attend Independent Medical Examinations
